7th CPC – NO COMPROMISE ON TERMS OF REFERENCE
GET READY FOR STRIKE IF GOVERNMENT REJECTS DA MERGER,
GDS INCLUSION & INTERIM RELIEF

Eventhough Government has announced constitution of 7th Central Pay Commission, the appointment is yet to take place. In the meanwhile one round of discussion was held with Secretary, DOP&T on terms of reference. Subsequently, the staff side, JCM National Council has submitted a unanimous proposal on the items to be included in the terms of reference of the 7th CPC, which includes (i) date of effect as 01.01.2014 (2) merger of DA with pay (3) grant of interim relief (4) inclusion of GDS under the ambit of 7th CPC (5) statutory pension for those entered into service on or after 01.01.2004 (6) settlement of anomalies of 6th CPC (7) cashless/hassle-free medicare facilities etc.

Government while announcing the 7th CPC has made it clear that the date of effect will be 01.01.2016. Further nothing has been mentioned about DA merger and interim relief. Regarding GDS the declared stand of the Government is that GDS are not civil servants and in the past also every time when CPC is appointed, the Government refused to include them in the Pay commission. Last time also inspite of the strong protest and agitational programmes conducted by NFPE and Postal JCA, the Government has appointed a bureaucratic committee. Regarding statutory pension to those who entered into service on or after 01.01.2004, the Government’s stand is well known and it may refuse to include this item also in the terms of reference.

This being the position, our past experience shows that unless and until the demands raised in the staff side proposal submitted to Government on terms of reference of the CPC is backed by serious agitational programmes, rallying the entire Central Government Employees and create compulsion on the Government to accept our justified stand, there is every possibility of Government rejecting the above proposal.


Further all of us are aware that the political situation in the country is gradually getting in election mode. This is bringing forth before the working class movement a crucial task of front-loading our class issues in the ensuring political battle. We have to keep in mind that the corporate class and corporate controlled media has started making effort for relegating the working class issues and the economic policy related issues in particular to the background. It is our duty to bring the demands of the working class to the fore-front and conduct intensive campaign against those policies and also against those who are supporting the neo-liberal globalization policies. Confederation of Central Government Employees & Workers and NFPE being the part and parcel of the mainstream of the working class of our country has got an added responsibility to rally the entire Central Government Employees in the struggle against the anti-people and anti-worker policies of the Government which shall ultimately lead to a change in the political equation ensuring implementation of pro-people, pro-worker alternative policy.

It is in this back the National Secretariat of the Confederation of Central Government Employees & Workers met at new Delhi on 28.11.2013 has decided to go for strike if the Government refuse to accept the staff side proposal on terms of reference. Confederation further decided to organize series of phased programme of action and campaign from now onwards so that the employees will be ready to go for strike on short notice.

NFPE call upon all the Postal, RMS and GDS employees to implement the call of the Confederation at all levels and be prepared to go for strike at any time, if situation warrants. We further make it clear that NFPE and Confederation will not go for any compromise on the demands raised in the proposal submitted by the JCM Staff side on terms of reference of 7th CPC.

HON’BLE SUPREME COURT OF INDIA


NFPE & AIPEU-GDS (NFPE) has filed a Writ Petition (Civil) No. 1003 of 2013 in the Hon’ble Supreme Court. The Writ Petition is likely to be listed for “ADMISSION HEARING” before the Hon’ble Supreme Court of India on 13.12.2013 or any day thereafter. Our main submission before the Hon’ble Supreme Court is implementation of the 1977 Judgment and grant of Civil Servant status and all other benefits of Departmental Employees to Gramin Dak Sewaks as per the 1977 judgment. Let us hope that the Writ Petition will be admitted.

Latest News: Govt workers want DA to be merged --- Pay Commission could be notified over the next two months. Govt workers want DA to be merged with salary.

Government employees have asked the Centre to consider merging Dearness Allowance with their pay, arguing that the Sixth Pay Commission -- quite like the Centre -- could not have anticipated the high inflation that has eroded real wages over the last decade.

Since 2006 – when the recommendations of the last pay commission came into force – the Dearness Allowance has increased to 90%, a reflection of the high inflation environment that employees have to cope up with.

The demand was made at a preliminary meeting held between the Department of Personnel and the Employee Representatives to discuss the proposed Seventh Pay Commission announced by Prime Minister Dr. Manmohan Singh in September.  

Congress media department chief Ajay Maken had asked the Prime Minister to announce the next pay commission in March this year. Writing in his capacity as a Cabinet Minister, Maken had also argued for a liberal increase in the salaries of government officials to attract and retain talent. 

Representatives of government employees weren’t as optimistic.

Umraomal Purohit, Secretary, Staff side, however, did stress on the merger of Dearness Allowance (DA) with the basic pay. Purohit said that the Sixth Pay Commission did not recommend merger as they could not have anticipated a high rate of inflation which resulted in employees being granted a 90% rate of DA.
Purohit and other representatives also emphasised that a system should be put in place to ensure that anomalies created due to recommendations of pay commissions should be resolved within a year of the implementation of the report.

Government sources said the pay commission could be notified over the next two months or so, well before the model code of conduct  for the general elections kicks in. Also, the Centre is expected to give the panel enough time to prepare its report in the hope that the government would be a lot more comfortable vis-a-vis the fiscal deficit by the time the panel submits its report.

NFPE IS 60 YEARS YOUNG
                National Federation of Postal Employees (NFPE) is a class-oriented militant organisation of above five lakhs postal employees. NFPTE was formed on 24.11.1954
                   The P&T trade union movement in India has inherited a history of struggles and sacrifices right from the days of British Raj.  During 1905 when there was no freedom to form unions, Babu Tarapada Mukherjee started this organisation in the name of a Postal Club at Kolkata GPO.  Tarapada was dismissed from service by the British Government for delivering a speech against the British Government in the year 1921 at Lahore All India Conference.  During the last more than one hundred years many leaders and workers of this organisation has been tortured, arrested and put under jail both by the British and Indian Governments.  Com. Dada Ghosh, founder Secretary General of NFPTE was arrested and placed under prolonged suspension. Com.N.J.Iyer, former All India President of NFPE was arrested for delivering a speech against “Emergency” in 1975 and imprisoned in Bikanir Jail for 18 months.  Com.K.Adinarayana, Former Secretary General of NFPE was in jail for three years for participating in the Telangara struggle against Nizam. Com. K. G. Bose, who electrified the P&T Trade Union movement with his class-oriented approach was dismissed from service. Many legendary leaders like Coms. O. P. Gupta, Henry Barton, V. G. Dalvi, K. L. Moza, A. S. Rajan, Piramanathan, N. C. Ambalavanan have lead this organization in the past.
                   25 days historic 1946 P&T strike is marked in the history of India’s freedom movement as one of the most militant struggle launched by P&T employees against the British Raj.  1960 five days strike of Central Government Employees, 1968 September 19th one day strike for Need Based Minimum wage in which 17 employees have been brutally murdered by the Government by resorting to firing and lathicharge. 1974 Bonus Strike, 1984 September 19th Strike for the emancipation of three lakhs Extra-Departmental employees, 1993 five day’s Postal Strike, 1996 eight days strike for bonus ceiling removal,  1998 eight days Postal strike, 2000 fourteen days Postal Strike were all lead by the National Federation of Postal Employees.  The one day strike by Confederation of Central Govt. Employees and Workers conducted last year on 12-12-2012 is another milestone in the history of Postal Trade Union movement.
                   NFPE has been participating in all the nationwide General strikes including the 2013 February 20,21 two days strike conducted by the Central Trade Unions, right from 1991 onwards against the Neo-liberal imperialist globalisation policies pursued by the Central Government.
                   NFPE has conducted innumerable struggles for realisation of the legitimate demands of the Postal employees especially the most down-trodden section of Gramin Dak Sevaks and Casual, Part-time, Contingent employees.
                   NFPE is an affiliate of the Confederation of Central Govt. employees and Workers and is playing leading role in mobilising the Central Government employees and organising struggles including nation wide strikes.
                   Due to neo-liberal policies implemented by the Central Government during the last more than two decades, the Central Services including Postal department is facing great threat against its existence.  Ban on recruitment, outsourcing, downsizing, contractorisation, contributory pension scheme, non-regularisation of the services of Gramin Dak Sevaks, restrictions on compassionate appointments, Bonus discrimination are all the off shoots of this policy.  Due to unprecedented price rise the real wages of the employees and workers have eroded like anything.  The Central Govt. employees are on continuous struggle demanding appointment of Seventh Pay Commission with effect from 01.01.2011, 50% DA merger, regularisation of Gramin Dak Sevaks and Casual labourers etc.
                   NFPE Federal council held at Hyderabad in June 2013 has decided to celebrate the Diamond Jubilee of NFPE in a befitting manner. Inaugural ceremony of one year long celebrations will be held at New Delhi on 24.11.2013 and final celebrations will be organized at Jam Nagar (Gujarath) in a grand manner on 24thNovember 2014.
                   One year long Diamond Jubilee celebrations of NFPE shall definitely discuss all the issues confronting the working class in general and the Postal employees in particular and formulate programmes for future course of action.
                   AIPEU Group C (CHQ) calls upon the entire postal employees to conduct seminars, general body meetings, trade union workshops, honouring former leaders, exhibitions, classes on the history of the postal trade union movement etc. during the period from 24th November 2013 to 24th November 2014 as part of Diamond Jubilee celebrations.
                   Let us be proud of being a part of this great and glorious organization and let us carry forward our uncompromising fight against all injustices.

MOBILE MONEY TRANSFER SERVICE, IN KARNATAKA CIRCLE.

            India Post, on Friday, announced the launch of Mobile Money transfer service, in Karnataka Circle, jointly with BSNL. With this, the facility to transfer money will start at 400 chosen post offices across the State in the first phase. It will be gradually extended to all 1,500 post offices across the State, Chief Post Master—Karnataka Circle M S Ramanujan said.

            M S Ramanujan said the service would be of great help to migrant population, who, otherwise, have to rely on other modes of money transfer. It will also benefit students who study away from their home towns, he added.

            Using this service one can transfer minimum of Rs 1,000/- and maximum of Rs 10,000/-. To use the service, senders would need to visit the post offices in the region where the service is available, deposit the amount and give the receiver’s details. After this, they would get a 16 digit transfer code on their mobile phone, which they would need to send to the recipient via SMS. The recipient can claim the money at a nearby post office, by showing the transaction code and verifying his identity. Recipient also needs to withdraw the money within 7 days of transaction

.           The objective of the service is to lower the cost of transaction to enable transaction of even very small amounts. The charge for transferring Rs 1,000/-  to Rs 1,500/- will be Rs 45/-, while for transferring Rs 1,501/- to Rs 5,000/-, the fee will be Rs 79/- and for Rs 5,001/- to Rs 10,000/-, the commission will be Rs 120/- including service tax.

Subject:- Productivity Linked Bonus for the Accounting year 2012-2013.
Sir/Madam,
                        I am directed to convey the approval of the President of India for payment of Productivity Linked Bonus for the accounting year 2012-2013 equivalent of emoluments of 60 (Sixty) days to the employees of Department of Posts in Group `D`,Group `C` and non Gazetted Group `B`. Ex-gratia payment of Bonus to Gramin Dak Sevaks who are regularly appointed after observing all appointment formalities and adhoc payment of Bonus to Casual labourers who have been conferred Temporary Status are also to be paid equivalent to allowance/wages respectively for 60 (sixty) Days for the same period.
1.1              The calculation for the purpose of payment of Bonus under each category will be done as indicated below.
2.                              REGULAR EMPLOYEES:
2.1       Bonus will be calculated on the basis of the following formula:-
                                                Average emoluments X Number of days of Bonus
30.4(Average no. of days in a month)
2.2 The term “Emoluments” for regular Employees include basic Pay in the pay Band plus Grade Pay, Dearness Pay, Personal Pay, Special Pay (Allowances), S.B.Allowance, Deputation (Duty ) Allowance, Dearness Allowance and Training Allowance given to Faculty Members in Training Institutes. In case of drawl of salary  exceeding Rs.3500/- (Rs. Three Thousand Five hundred only) in any month during the accounting year 2012-13 the Emoluments shall be restricted to Rs.3500/- (Rs. Three Thousand Five hundred only) per month only.
2.3 “ Average Emoluments” for regular Employees is arrived at by dividing by twelve ,the total salary drawn during the year 2012-13 for the period from 1.4.2012 to 31.3.2013, by restricting each month’s salary to Rs.3500/- (Rs. Three Thousand Five hundred only) per month. However, for the periods  of EOL and dies-non in a given month ,proportionate deduction is required to be made from the ceiling limit of  Rs.3500/- (Rs. Three Thousand Five hundred only).
2.4 In case of those regular employees who were under suspension, or on whom dies-non was imposed ,or both, during the accounting year, the clarificatory order issued vide Paras 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt-I) dated 11.6.81 and No. 26-4/87-PAP (Pt.II) dated 8.2.88 will apply.
2.5              Those employees who resigned, retired, left service or proceeded on deputation within the Department of Posts or those who have proceeded on deputation outside the Department of Posts on or after 1.4.2012 will also be entitled to Bonus. In case of all such employees, the Bonus admissible will be as per provisions of Para 2.1 to 2.3 above.
3.                  GRAMIN DAK SEVAKS (GDS)
3.1  In respect of Gramin Dak Sevaks who were on duty through out the year during 2012-2013, Average monthly Time Related Continuity Allowance will be calculated taking into account the Time Related Continuity Allowance (TRCA) plus corresponding Dearness Allowance drawn by them for the period from 1.4.2012 to 31.3.2013 divided by 12 (Twelve). However, where the Time Related Continuity Allowance exceeds Rs 3500/- (Rs.Three Thousand Five hundred only) in any month during this period., the allowances will be restricted to  Rs 3500/- (Rs.Three Thousand Five hundred only) per month. Ex-gratia payment of Bonus may be calculated by applying the Bonus formula as mentioned below:-
                                          Average TRCA  X  Number of days of Bonus
                                                     30.4 (Average no. of days in a month)
3.2      The allowances drawn by a substitute will not be counted towards Bonus calculation for either the substitute or the incumbent Gramin  Dak Sevaks. In respect of those Gramin Dak Sevaks who were appointed in short term vacancies in Postman/Group `D` Cadre, the clarificatory orders issued vide Directorate letter No. 26-6/89-PAP dated 6.2.1990 and No.  26-7/90-PAP dated 4.7.91 will apply.
3.3      If a Gramin Dak Sevak has been on duty for a part of the year by way of a fresh appointment, or for having been put off duty, or for having left service, he will be paid proportionate ex-gratia Bonus calculated by applying the procedure prescribed in Para 3.1
3.4        Those Gramin Dak Sevaks who have resigned, discharged or left service on or after 1.4.2012 will also be entitled to proportionate ex-gratia Bonus. In case of all such Gramin Dak Sevaks, the Ex-gratia Bonus admissible will be as per provisions of Para 3.1 above.
3.5      In case of those Gramin Dak Sevaks who were under put off duty or on whom dies non was imposed, or both during the accounting year ,the clarificatory orders issued vide Para 1 & 3 respectively of this office order No. 26-8/80-PAP (Pt I) dated 11.6.81 and No. 26-4/87-PAP (Pt II) will apply.
4.                  FULL TIME CASUAL LABOURERS INCLUDING TEMPORARY STATUS CASUAL LABOURERS)
            Full Time Casual Labourers (including Temporary Status Casual Labourers ) who worked for 8 hours a day, for at least 240 days in a year for three consecutive years or more (206 days in each year for three years or more in case of offices observing 5 days a week) as on 31.3.2013 will be paid ad-hoc Bonus on notional monthly wages of Rs.1200/- (Rupees Twelve Hundred only)
 
                                          The maximum ad-hoc Bonus will be calculated as below:-
                                    (Notional monthly wages of Rs.1200) X (Number of days of Bonus)
                                                            30.4 (average no. of days in a month)
                        Accordingly , the rate of Bonus per day will work out as indicated below:_
                                                            Maximum ad-hoc Bonus for the year
                                                                                       365
            The above rate of Bonus per day may be applied to the number of days for which the services of such casual labourers had been utilized during the period from 1.4.2012 to 31.3.2013. In case where the actual wages in any month fall below during the period 1.4.2012 to 31.3.2013 the actual monthly wages drawn should be taken into account to arrive at the actual ad-hoc Bonus due in such cases.
5.         The amount of Bonus /Ex gratia payment /Adhoc Bonus  payable under this order will be rounded to the nearest rupee. The payment of Productivity Linked Bonus as well as the ex-gratia payment and ad-hoc payment will be chargeable to the Head `Salaries` under the relevant Sub –Head of account to which the pay and allowances of the staff are debited. The payment will be met from the sanctioned grant for the year 2013-2014.
6.         After payment, the total expenditure incurred and the number of employees paid  may be ascertained from all units by Circles  and consolidated figures be intimated to the Budget Section of the Department of Posts. The Budget Section will furnish consolidated information to PAP  Section about the total amount of Bonus paid and the total number of employees (category-wise) to whom it was distributed for the Department as a whole.

PAYMENT OF DEARNESS ALLOWANCE TO GRAMIN DAK SEWAKS (GDS) AT REVISED RATES W.E.F. 01.07.2013 ONWARDS.

            Consequent upon grant of another installment of dearness allowance , with effect from 1st July,2013, to the Central Government Employees vide Government of India, Ministry of Finance , Department of Expenditure, O.M. No.1-8/2013-E.II(B)dated 25th September, 2013, duly endorsed vide this Department’s letter No. 8-1/2012-PAP(PT) dated 25.09.13, the Gramin Dak Sewaks (GDS) have also become entitled to the payment of dearness allowance on the basic TRCA at the revised rate with effect from 01.07.2013. It has, therefore, been decided that the dearness allowance  payable to the Gramin Dak Sewaks shall be enhanced from the existing rate of 80% to 90% on the basic Time Related Continuity Allowance , with effect from the 1st July, 2013.

2.         The additional installment of dearness allowance payable under this order, shall be paid in cash to all Gramin Dak Sewaks.

3.         The expenditure on the account shall be debited to the Head” Salaries” under the relevant head of account and should be met from the sanctioned grant.

4.         This issues with the concurrence of Integrated Finance Wing vide their Diary No. 155/FA/2013-CS dared 01.10.2013.

INTERNATIONAL DAY OF ACTION

Call from World Federation of Trade Unions
Dear Comrades,
                As you are aware, the World Federation of Trade Union was founded in an international conference of Trade Unions held at Paris from 3rd October, to 8th October, 1945.  At the 16thConference of WFTU held at Athens, Greece in April, 2011, it was decided to observe 3rd October, every year (the foundation day of WFTU) as International day of Action.  In 2012, we observed the day raising the demand for food, water, health, education and housing for all.
Food: 850 million people in the world are undernourished.  India is on the tgop of nations with largest member of cases of malnutrition.
Water: Privatisation of water, has caused havoc as it has become one of the most profitable enterprise.  The people’s right to water(without which life cannot exist) is trampled upon in many countries in favour of Corporate profits.
Education: Education has become a commercial activity after the advent of neo liberal economic policies.  The campaign for free education for all must be made intensive.
Health: Health is an extremely lucrative business.  Govt. of India over the years since 1991 has withdrawn itself from this sector making private enterprises to thrive increasing the agony of the people.
Housing: A large number of our population has no dwelling place today.  There is no governmental initiative in the matter in most of the countries.  The poor people all over the world are left high and dry.
WFTU has now called upon the workers of the world to reiterate these demands, observe 3rdOctober, as International day of Action by holding rallies, demonstration etc.  All employees may be requested to wear the badge depicting the five demands mentioned above on 3.10,2013. A specimen of the badge is appended hereunder.
