Copy of Charge-sheet cannot be denied under RTI Act : CIC.

The CIC Prof M Sridhar Acharyulu held on 3rd November 2014 that ‘charge-sheet’ has to be disclosed after separating non-disclosable portions, if any, as per restrictions prescribed under RTI Act. Ms. Usha Kanth Asiwal sought to know from Director of Vigilance Delhi, details of complaint made to Anti Corruption Bureau on 25-04-2001 and  inquiry leading to registration of case against 13 persons under Prevention of Corruption Act, which is now under prosecution in Tis Hazari Courts. She sought 22 point information, which broadly relate to contents of the Charge-sheet.

The PIO denied the information u/s 8(1)(h) of the RTI Act claiming disclosure would impede investigation or prosecution.  The First Appellate Authority upheld the decision of the PIO.  She approached the Commission in second Appeal. Though demand was not for copy of charge-sheet, the appellant agreed that a copy of charge-sheet would answer his application. Then issue before the Commission was whether charge sheet was public document, and if so could that be shared under RTI Act with any citizen.

CIC Prof Sridhar Acharyulu explained: ‘The charge sheet is a report held by the investigating officer, or public authority or court of law. As per the RTI Act, any information held by the public authority can be accessed by the citizen subject to the exceptions provided under Section 8. Because the charge-sheet contains the evidence which need to be adduced in the court of law, there is a possibility of opening up many details which could be personal or private or confidential. If the allegation requires to be proved by call data, the charge sheet refers to sheets of call data, which surely contain call details unrelated to allegation. That could be private information need to be protected. Hence each charge sheet has to be separately examined and only after separating unnecessary and unrelated details of evidence, and only required and permissible information out of chargesheet should be disclosed. Thus Charge-sheet can neither be prohibited enbloc from disclosure nor disclosed totally. Charge-sheet is a document held by concerned authority, which has to examine disclosable aspects vis-a-vis Section 8 and 9 of the RTI Act and then decide the case’.

As per the Criminal Procedure, the charge-sheet is the end product of investigation. With filing of charge-sheet, the investigation is closed and defense that investigation might get impeded does not stand at all.    Whether revealing the information impedes apprehension or prosecution is the next question. The Respondent authority did not even raise this point and did nothing to explain the Commission about possibility of impeding apprehension/prosecution by disclosure.  The Public Authority just mentioned the section number and did nothing else. The First Appellate Authority also did not apply the mind and chose not to give any reasons for upholding the denial by PIO. The exemption of larger public interest provided in Section 8(1) is not available to this clause (h). Thus it has to be decided on facts whether disclosure of charge-sheet will really obstruct investigation, apprehension or prosecution. The judgment of the Delhi High Court in W.P.(C) No.3114/2007 – Shri Bhagat Singh Vs. Chief Information Commissioner & Ors on this aspect is of relevance, since it deals with the applicability of the Section 8(1)(h) of the RTI Act 2005: S Ravinder Bhat J specifically notes, “As held in the preceding part of the judgment, without a disclosure as to how the investigation process would be hampered by sharing the materials collected till the notices were issued to the assessee, the respondents could not have rejected the request for granting information. …”

It can be inferred that there is no specific provision anywhere prohibiting the disclosure of charge-sheet and if there disclosure does not affect investigation or prosecution it can be permitted under RTI, unless there is a public interest against disclosure. The chargesheets containing charges under Prevention of Corruption Act, especially against public servants, need to be in public domain, in public interest.

Citing several decisions the CIC said: There is no specific provision under any law which state that charge-sheet is a public document, but there are several judgment of the Supreme court and High court which clarify that charge sheet is a public document. Queen-Empress v. Arumugan and Ors ( (1897) ILR 20 Mad 189) has held that any person has an interest in criminal proceeding has a right to inspect under section 76 of the Indian Evidence Act. In N David Vijay Kumar v The Pallavan Gram Bank, Indian Bank in File No. CIC/SG/A/2012/000189 CIC Mr Shailesh Gandhi ordered disclosure of Charge sheet ruling out the contention of exemption under Section 8(1)(j).

On the perusal of the RTI application, the Commission found that the  information sought by the applicant are the part and parcel of the information contain in the charge-sheet prepared after the completion of the investigation under section 173 of Cr. P. C. The purpose of the appellant will be served if the copy of the same would be provided to the appellant. The respondent authority also agreed to provide the copy of charge sheet.

Considering the provisions of Cr.P.C., Evidence Act, RTI Act, erudite judicial pronouncements, certain transparency practices in CVC,  facts and circumstances of the case and contentions raised, the Commission holds that the charge sheet is a public document and it shall be disclosed subject to other restrictions provided under RTI Act. There cannot be a general hard and fast rule that every charge-sheet could be disclosed or should not be. Each RTI request for copy of Charge-sheet required to be examined and only permissible part should be given.  The Commission, hence, directed the respondent to examine the content of charge-sheet and to provide appellant/… the copy of those portions of charge-sheet, which would answer the queries raised by appellant in his RTI application, within 3 weeks from the date of receipt of the order.

NOW THE CAT IS OUT OF THE BAG - GRAMIN DAK SEVAKS WANT INCLUSION IN 7th PAY COMMISSION - BUT RECOGNISED GDS UNION (MAHADEVAIAH) WANT SEPERATE ONE MAN COMMITTEE - RECOGNITION SHOULD NOT  BE A LICENCE TO CHEAT POOR GDS

1. Honourable Supreme Court of India in 1977, Fourth Pay Commission headed by Retired Supreme Court Justice Shri Singhal in 1988 and Retired Delhi High Court Justice Shri  Charanjit Talwar in the year 1998 has clearly stated in their judgments and reports that three lakhs Gramin Dak Sevaks working in the Postal Department are CIVIL SERVANTS (Govt Employees). Govt has appointed Seventh Pay Commission to examine the wages and service conditions of all Central Govt Employees.GDS being Civil Servants should be included in the terms of reference of 7th Pay Commission itself. There should not be any discrimination. This is the demand of Postal Joint Council of Action (NFPE, FNPO, AIPEU -GDS (NFPE) & NUGDS) and Confederation of Central Govt Employees & Workers and also the demand of entire JCM National Council Staff side Organisation's including Railways, Defence  & Confederation.

2. But unfortunately the leader of the RECOGNISED GDS UNION Shri MAHADEVAIAH do not want GDS to be included in the 7th Pay Commission. He want a seperate ONE MAN COMMITTEE for GDS. He signed a respectful (!!!) agreement with the Department when UPA (Congress) Govt. was in power agreeing for a seperate committee. THUS THE RECOGNISED GDS UNION SIGNED THE DEATH WARRANT OF THREE LAKHS GDS. Further Shri Mahadevaiah wrote to the Department NOT TO PERMIT NFPE & FNPO to take up GDS cases with the Department. After NDA (BJP) Govt coming to power Shri MAHADEVAIAH again submitted memorandum to the Minister Communications and Secretary, Department of Posts REQUESTING APPOINTMENT OF SEPERATE ONE MAN GDS COMMITTEE.As the recognised GDS Union of Shri MAHADEVAIAH has already agreed for seperate one man committee , new BJP Govt may go ahead with the appointment of seperate one man GDS committee.THUS RECOGNITION HAS BECOME A LICENCE TO CHEAT THREE LAKHS POOR GDS EMPLOYEES.

3. Postal Joint Council of Action (NFPE, FNPO, AIPEU - GDS (NFPE) , NUGDS) strongly oppose any move to appoint seperate one man committee for GDS and we are demanding inclusion of GDS under 7th Pay Commission itself. We have already submitted memorandum to Honourable Prime Minister Shri Narendra Modiji and Communications Minister Shri Ravi Shankar Prasadji. We are also conducting phased programme of agitational programmes. On 2014 December 4th there will a massive Parliament March of 20000 Postal and RMS employees including thousands of Gramin Dak Sevaks from all 22 circles demanding inclusion of GDS under 7th Pay Commission. If the Govt with the consent and support of Shri MAHADEVAIAH go ahead with the appointment of one man GDS Committee, then the JCA will declare higher form of trade union action including indefinite strike.

JCM STAFF SIDE UNITY SHOULD BE FOR STRUGGLE

            History of Central Government Employees reveals that Government has taken undue advantage to deny the justified demands of the Central Government Employees, whenever there was disunity among the JCM staff side organizations. On the contrary, whenever staffside stood solidly united the Government was compelled to concede the legitimate rights of the employees to a great extent.

            After Fifth  Pay Commission recommendations, the JCM National council staffside submitted to Government a common charter of demands for modifications of the recommendations of the Pay Commission, which included upward revision of fitment formula and removal of certain glaring anomalies. When Government refused to concede it , notice for indefinite strike was given and finally the Government had to appoint a high-power Group of Ministers Committee under the chairmanship of then Home Minister Shri.Indrajith Gupta and negotiated with the staffside.  In the negotiations also the staffside took a united uncompromising stand which ultimately resulted in Government accepting the demand for 40% fitment formula and some other important demands.

            Unfortunately, when the Sixth Pay Commission recommendations were  submitted to Government, the JCM National Council Staffside miserably failed to take such a firm and united stand and no serious agitational programme was conducted demanding modification of the retrograde recommendations. Instead the dominant leadership of JCM staffside took a compromising stand and depended only on negotiated settlement , without mobilizing the entire rank and file membership behind the demands. Ultimately Government took advantage of this weakness of the leadership and unilaterally announced the implementation of the 6th CPC recommendations, without conceding majority of the genuine demands raised by the staffside during negotiations. Faulty formula adopted for calculation of  Need Based Minimum Wage , glaring disparity in fitment and fixation formula between lower level officials  and Group- A officers, unscientific pay band and grade pay system and serious anomalies arising out of it , MACP anomalies   everything remained as such  which could not be settled even after seven years.

            Again , when the Government announced the New Contributory Pension Scheme with effect from 01.01.2004 for the new entrants in Central Government Services without any consultation with the JCM National Council Staffside, the dominant  leadership of the JCM staffside did not protest and kept silent. This has emboldened the Government to go ahead with the implementation of the neo-liberal pension reforms. Had the entire JCM Staffside including Railways, Defence and Confederation taken a united stand to oppose the New Pension Scheme and given call for serious agitational programmes including indefinite strike the Government would not have dared to implement the NPS. Of course , Confederation of Central Government Employees and workers opposed the New Pension Scheme and has gone to the extent of conducting one day strike. JCM leadership raised the demand for roll-back of NPS after a very long time and by that time Government succeeded in fully implementing the scheme.

Confederation of Central Government Employees and workers has always stood for unity among the Central Government Employees .When confederation submitted a 15 point charter  to the UPA Government in 2011 demanding appointment of 7 th CPC , 5 year wage revision , Merger of 50% DA, Inclusion of Gramin Dak Sevaks under 7thCPC etc, the  other major organizations in the JCM were not ready to raise the demands in 2011. Finally confederation was forced to go it alone and conducted series of agitational programmes including Parliament March, one day strike and two days strike. Of course, the lonely struggle conducted by confederation represented the mood of the entirety of Central Government Employees and ultimately the Government was compelled to announce constitution of 7th CPC in the month of September 2013.
           
                        Now NDA Government which came to power after General   Election has rejected all the main demands of the Central Government Employees which includes merger of DA , Interim Relief , Date of  effect  from 01.01.2014 , inclusion of GDS in the terms of reference of 7th CPC ,scrapping of New Pension Scheme etc. Further Government declared 100% FDI  in Railways and Defence. Public Private Partnership in Railways was also announced in Railway budget. More than five lakhs posts are lying vacant in various Departments out of which about 2.5 lakhs vacancies are in Railways alone. The UPA Government has unilaterally announced the terms of reference of the 7th CPC rejecting the draft proposal submitted by JCM staffside.  The memorandum submitted by JCM staffside to the NDA Government for grant of merger of DA and Interim Relief also was totally neglected. The JCM Staffside leadership could not do anything and the employees are suffering. In fact the JCM staffside has become a laughing stock among the employees and its credibility in the eyes of the employees has eroded like anything.

                        It is in this background , eventhough belatedly , the JCM National Council Staffside has decided to organize a National Convention at New Delhi on 11th December 2014 , to discuss and finalise its strategy to combat the above humiliation meted out by the Government . Better late than never. The decision is well received by the entire Central Government Employees and they are eagerly waiting for the outcome of the convention.

                        NFPE  firmly believes that if the present unity among the JCM staffside organizations is not channelized for building up united struggle including indefinite strike of entire Central Government Employees the National Convention will become a futile exercise and an eye-wash to cool down the growing discontentment among the employees. This shall not happen. We firmly believe in the slogan raised by our late legendary leader Com K.G.Bose- i.e  “UNITY FOR STRUGGLE AND STRUGGLE FOR UNITY”. Such a stand alone can restore the lost glory of the fighting potential of the Central Government Employees and also shall regain the lost faith of employees in the JCM staffside leadership. We cannot be a party to any compromise on the genuine and justified demands of the workers. Let us hope that the JCM staffside leadership shall rise up to the occasion.

Government to launch revamped Kisan Vikas Patra soon: Finance Ministry.

New Delhi: The government will soon launch the revamped Kisan Vikas Patra (KVP) besides some new saving instrument programmes for the girl child as well for the physically challenged person, a senior Finance Ministry official said on Tuesday.


"We are going to launch the revamped Kisan Vikas Patra (KVP) soon again in the form of saving instrument," Rajat Bhargava, Joint Secretary (Budget) in the ministry finance said at an event here.
    
"Similarly, the government of India is also going to launch some new saving instrument programmes for girl child as well as for the physically challenged person who has not been covered so far (under the programme)," Bhargava added.
     
Finance Minister Arun Jaitley, in the Budget speech, had said he will re-introduce the KVP, which was a very popular instrument among small savers.
    
"I plan to reintroduce the instrument to encourage people, who may have banked and unbanked savings to invest in this instrument," Jaitley had said.
    
The KVP was discontinued by the UPA government in 2011 following the Shyamala Gopinath Committee report. It had suggested that KVPs may be discontinued as they are prone to misuse.
     
KVP was a popular saving scheme that doubled the money invested in eight years and seven months. The government sold these saving bonds through Post Offices in the country.
    

The new government has identified financial inclusion and access to formal financial channels as a priority area and the reintroduction of KVP is seen as furthering this objective.

PRESS NEWS: Government employee can't seek promotion after refusing it: Supreme Court.

NEW DELHI: A government employee, whose promotion is canceled owing to his refusal to accept it, cannot ask for it at a later stage, the Supreme Court has said.

The apex court set aside the order of the Madhya Pradesh High Court which had directed the state government to restore the promotion of one of its employees whose promotion was cancelled after he turned down the offer as he did not want to get transfered to some other place.

"As we find that it is the respondent himself who is responsible for cancellation of the promotion order as he did not join the promoted post, the impugned order of the high court is clearly erroneous and against the law," a bench headed by Justice J Chelameswar said.

The court passed the order on an appeal filed by Madhya Pradesh government challenging the high court order.

The government had submitted that the high court failed to consider that Ramanand Pandey himself sent back the promotion order and continued on his post and approached the court after two years when it cancelled his promotion.

It said that at the time of promotion, Pandey was posted in Bhind district where he remained for almost 15 years and his intention was to stay at that place only.

The apex court, after hearing both sides, quashed the high court order.

"It is clear that he wanted to remain in Bhind district, where he had continued since 1990, as he was ready to go on leave instead of joining the place of transfer. Moreover, for more than two years from the date of cancellation of the order of promotion, the respondent kept totally mum and maintained stoic silence.

"There was not even a semblance of protest as to why his promotion order was cancelled or that he wanted to join the promotion post after the alleged inquiry into the so-called complaint was over. He filed the writ petition on October 24, 2008, i.e. almost two years after cancellation of his promotion order," it said.

                   One year long nationwide Diamond Jubilee Celebrations of National Federation of Postal Employees (NFPE) which commenced on 24th November 2013 at New Delhi is coming to a grand finish on 23rd and 24th November 2014 at Dwarka (Gujarat).  NFPE has already celebrated the Golden Jubilee of Postal Trade Union movement in the year 2004 at Thiruvananthapuram, marking the 100th year of establishing “Postal Club” at Kolkata by Late Com. Babu Tarapada Mukherjee, the founder father of Postal Trade Union, which was later on converted by him as All India Postal and RMS Employees Union.  NFPTE was formed on 24th November 1954, in a massive convention held at Vinay Nagar, New Delhi.  After bi-furcation of Postal and Telecom, the name of Postal Federation is changed as NFPE.
                   When we celebrate 60th year of our glorious organisation, we should pledge to re-dedicate ourselves not only for fighting for the cause of five lakhs Postal and RMS employees including Gramin Dak Sevaks but also for the cause of entire Central Government employees and the suffering masses of our country and the world.
                   We should inherit the legacy of our great leaders and follow their footsteps - their dedication, commitment, sacrifice, knowledge, militancy, courage, honesty, concern and respect for the fellow workers and seniors, giving topmost priority to individual grievances, democratic and transparent functioning, oraganisational discipline, building up trade union consciousness, social consciousness, political consciousness and above all class consciousness.
                   We have been fighting against the neo-liberal policies of the Government, right from its beginning from 1991 onwards.  We conducted many heroic struggle against downsizing, outsourcing, contractorisation and privatization.  We succeeded in compelling the Government to lift the ban on recruitment and filling up of all vacancies, we succeeded in preventing the Government from implementing its order for closure of 9797 Post offices, we succeeded in halting Mckinsey recommendations and Mail Network Optimisation Project (MNOP) for closure of about 300 RMS Offices.  We could successfully prevent the Government from amending the Indian Post Office Act and giving license to multi-national courier services.   Our fight for emancipation of three lakhs Gramin Dak Sevaks has not yet reached its finality.  We have to complete our unfinished task.
                   Seventh Central Pay Commission has commenced its work.  Our demands for DA merger, Interim Relief, Inclusion of GDS under 7th CPC, date of effect from 01-01-2014, scrapping of new pension scheme, parity in pension etc. are still pending. Government, whether it is UPA or NDA, is totally negative to our genuine demands.  Our struggle under the banner of NFPE and Confederation of Central Government Employees and Workers is to be further intensified.
                   Eventhough we have submitted detailed memorandum to 7th CPC for better wages and service conditions, neither the 7th CPC nor the Government shall concede our demands, unless we mobilize the workers at all levels in a serious and determined manner and create sanction behind our demands.

                   Thus the message of Diamond Jubilee of NFPE is loud and clear.  We have to continue our struggle against the anti-labour, anti-people policies of the Government, we has to fight against the neo-liberal reforms in the Central Government employees sector, we have to conduct bigger form of trade union action including indefinite strike for realization of the demands of the Central Government employees and Postal employees including Gramin Dak Sevaks.  We shall not rest till the dreams of our founder leaders are fulfilled.

JCM Staff Side leadership has decided to organize a National Convention of all Central Government Employees (Railway, Defence & Confederation) on 11th December 2014 at New Delhi from 12 PM to 4 PM. Convention will adopt a joint resolution on the common demands of the Central Government Employees viz; Merger of DA, Interim Relief, Inlcusion of GDS under 7th CPC, Scrap New Pension Scheme etc and will declare joint programs of action. Further details regarding number of delegates to be participated from each affiliated Organisation & State C-O-Cs of Confederation will be published shortly.

In this series, it has also signed Business MOU with snapdeal.com & shopclues.com. 

India Post is celebrating National Postal Week from 9th to 15th October, 2014 and on the occasion of Business Development Day on 14th Oct 2014 it decided to join hands with Snapdeal.com & shopclues.com.

Mr. Vijay Ajmera, Sr. Vice President (Finance) Snapdeal.com said that they are happy to choose Department of Post as their delivering partner and this partnership will provide their e-commerce business a wider reach and network. 

In tune with the emerging e-Commerce market, parcel product has been revamped & Cash on Delivery (CoD) facility has been introduced. State-of-the-art Parcel centres are also being set up across the country. Department is also developing exclusive Parcel Network to cater the needs of e-Commerce companies.
