STRENGTHEN ORGANISATION
ENSURE DEMOCRATIC FUNCTIONING
BUILD UP CLASS-ORIENTED MILITANT ORGANISATION

It is an admitted fact that our organisation, AIPEU Group ‘C’ and NFPE, has grown in its strength and in terms of its movements and intervening capacity throughout the country. But there is no room for complacency, given the challenges before and the responsibilities fallen on us. We have to strengthen our organisation further both quantitatively and qualitatively.

In building, running and strengthening a trade union organisation, democratic functioning plays the role of a cornerstone. To put it differently, the source of many of the ills of our organisationlies in the absence of democratic functioning. Therefore the importance of democratic functioning should be clearly understood by everyone of us.

Democratic functioning in essence is to involve the mass of the workers in the decision making process and their implementation. This requires a well knit and functional system of regular contacts and participative communication with the workers at grass root level on the one hand and collective functioning of the leadership team at various tiers of the organization.

To mention a few specifics of democratic functioning of a union are (a) mode of discharging their responsibilities by the leadership (b) attitude while dealing with the rank and file workers (c) relationship between the leadership bodies of the union and general workers, (d) the norms for working of the various committees, (e) collective functioning in the process of decision making and implementation, (f) conducting meeting of the committees and conferences of the union, (g) management of the union fund and maintenance of books of accounts etc. and the last but not least a functional mechanism of communicating with the mass of the workers at grass root level and also hearing from them. Growing bureaucratic practices in the functioning of the Union are creating serious impediments in strengthening democratic functioning in the Unions at some places. Individualistic way of working by some of the leaders and activists promotes bureaucratism within the organisation. To fight such as situation what is needed is to ensure the collective functioning, to and fro communication amongst the leaders, cadres and general workers.

Another vital area of the democratic functioning is the meetings of the Executive committees and office bearers of the union. In some places regular meetings of these bodies are generally not taking place. Attendance is also much below the required level and defaulting comrades are not dealt with according to the norms of democratic discipline. Then again, the meetings are not properly planned. No written report reviewing the developments of the period between the two meetings and status of implementation of the decisions of the previous meeting is placed before the body concerned. Similar is the situation with regard to a written statement of accounts, membership position etc. Holding the union conferences regularly is a very important organizational requirement. Unfortunately, there are instances of conferences not being held regularly, in violation of constitutional provisions. Such failure is bound to have serious organizational problems and weaknesses. For efficient and effective functioning of an organisation the above mentioned deficiencies are to be dealt with seriously.


Finally we must always remember that without imparting trade union education and inculcating trade union consciousness and class consciousness in the cadres and workers the present malices in the unions narrated above cannot be addressed. Whole package of neo-liberal reforms and the philosophy and strategy supporting the same are meticulously designed for marginalizing and weakening the trade union movement. Trade Union is the only social force, which if properly organized can, pose a challenge against the neo-liberal regime and mobilize the people around it. In fact, tackling trade union movement and subordinating the same has always been the life and death question for the capitalist system and in the era of neo-liberal reforms they are much more focused on this goal of theirs with all their ideological and organizational weaponaries at their command. It is therefore, all the more imperative to ideologically empower our leaders and cadres to powerfully counter the onslaughts of the capitalist class.

PA/SA DIRECT RECRUITMENT RESULT. LATEST NEWS FROM OUR CHQ.

It is informed that the circle wise final result of PA/SA direct recruitment exam will be announced during the period from 1st August to 30th September 2013. Valuation of exam papers already over and Hall permit for computer test will be issued shortly. It is proposed to have online computer test for the selected candidates. About 14 lakhs candidates appeared in the exam for PA for the vacancies around 5100.

A joint meeting of the leaders of Railway (AIRF), Defence (AIDEF) and Confederation of Central Government Employees & workers will be held at New Delhi on 29th June 2013 for deciding future course of joint action. The meeting earlier scheduled to be held on 15th June 2013 is postponed to 29th June 2013.

As per the decision taken in the last working comm.meeting of our divisional union's, let us prepare ourselves for the next biennial conference to be held at Howrah. The most tentative date will be 07.07.2013. So,all comrades are requested to prepare themselves for the same. Its our duty to make it a grand success. The members donation for the conference are the same as the previous conference in the year 2011.
Members donation will be  PA -- Rs.300, POSTMEN & Gr.D-- Rs.200, GDS-- Rs.100.
So,all members are requested to take all out effort for its success.
 
If there will be any change in the date of the conference,it will be intimated accordingly.

Shri G.K Padmanabhan Ex. SG FNPO expired   on 06/06/2013 at New Delhi. He has played an important role in building up the Joint Council of Action (NFPE/FNPO) and organized united struggle of Postal and RMS Employees. NFPE Group of postal  unions,Howrah Dn. conveys its heartfelt condolences.


Abolition of Posts - Legal Position.

As per the orders issued by the Government of India in 2001 for abolishing posts as per screening committee recommendations, only 2/3 direct recruitment vacancies should be abolished. Promotional Posts should not be abolished. Based on this order NFPE Kerala filed a case in CAT Ernakulam against abolishing Postmen & Group ‘D’ posts, as these posts are promotional posts of GDS employees. Department argued that promotion from GDS to Postman/MTS is direct recruitment and not promotion. But CAT has not accepted Department arguments. CAT, Ernakulam bench delivered a Judgement that promotion from GDS to Postman/MTS is not direct recruitment but promotion. CAT Directed CPMG not to abolish Postman/MTS posts and to fill up all the posts by promoting GDS.

Department went on appeal to High court Kerala. But High Court confirmed CAT order. Accordingly in Kerala circle all the promotional posts of GDS were filled by promoting GDS. Based on the same order now P4 CHQ and GDS (NFPE) have filed a case in Principal CAT and obtained stay order from abolishing Postmen & MTS posts.

Some comrades are asking why abolition of PA/SA posts cannot by stayed. Department is not abolishing the promotional posts in the PA and SA cadre (LGOs vacancies). But they are abolishing direct recruitment vacancies only.

Eranakulam CAT order is not applicapable to Direct recruitment vacancies. It is applicable to promotional vacancies only. In the PA/SA cadre there is no promotional vacancy for GDS in the oustide quota (Direct Recruitment Quota). This is the legal position. There is no chance for getting stay order for PA/SA direct recruitment post as it is not promotional post. This is the legal advice received by us.

NFPE and CHQ has protested against the abolition of Posts, but Department of posts is taking a stand that eventhough they have tried best to get exemption from abolishing direct recruitment posts, the Government of India has not granted any exemption and hence the Direct recruitment vacancies recommended by screening committee up to 2008 have to be abolished. From 2009 onwards there is no abolition of posts and all the vacancies can filled up as per the orders of the Department.

Regarding postmen and MTS abolition, the abolition is stayed on Technical grounds stated above because the CAT Ernakulam has clearly ruled that promotion from GDS to Postman & MTS is not direct recruitment.

This argument cannot be raised in the case of PA/SA direct recruitment vacancies.


GDS BOs are going to be supplied with bicycles .

Sub: Supply of bicycles to GDSs working in Branch Post Offices - Regarding

The criteria for supply of bicycles to GDSs working in Branch Post Offices as per the Directorate letter No.17-3/2013-MV dated 29.05.2013 are as follows:

            (1)   GDS Delivery Agent should cover at least 3 KMs per day for delivery of mails.

          (2)   GDS Delivery Agent as also GDS DA doing the combined duty of BPM and/or   Mail Carrier is eligible for bicycle.

            (3)   Only one bicycle will be supplied to a Branch Office.

       (4)   Where the delivery jurisdiction is limited to the village where Branch Office located, no bicycle would be supplied.

As per the criteria mentioned above I am directed to request you to kindly intimate the number of BOs that served more than one village and the number of bicycles required for your Division latest by 1600 hours of today (03.06.2013) through e-mail positively for report to Directorate.
